A Fox News commentator and former Bergen County judge, Andrew Napolitano, has “divorced.” His attorney stated that his departure from the cable news network came before the most recent sexual harassment allegation.
In a complaint filed against Fox Business on Monday, December 13, 2021, Fox Business production assistant John Fawcett accused Napolitano of sexual harassment.
“Judge Napolitano vehemently rejects any form of harassment,” his attorney Michael Sirota stated in an email.
Fox News stated in a statement that it had parted company with Napolitano by saying,
“Upon first learning of John Fawcett’s allegations against Judge Andrew Napolitano, FOX News Media immediately investigated the claims and addressed the matter with both parties.”
“The network and Judge Napolitano have since parted ways.
We take all allegations of misconduct seriously, are committed to providing a safe, transparent, and collaborative work environment for all our employees and took immediate, appropriate action.”
Fawcett said in the complaint that Napolitano sexually assaulted him in an elevator in 2019. He also stated that he had harassed several young male colleagues. In the lawsuit, he was not named as a defendant.
“Judge Napolitano’s misconduct was reported to Fox’s human resources department by the plaintiff and others, and senior executives were aware of Judge Napolitano’s serial harassment,” Mr. Fawcett said. “But, he took no action whatsoever against him.”
A Fox News spokeswoman refuted the charges and stated that the network intends to “vigorously” fight the case in court. According to Michael Sirota, Napolitano left Fox two months before filing the case.
Mr. Sirota further stated that the choice to leave was made amicably “in the context of an ordinary course contract expiration.”

The lawsuit is not Napolitano’s first accusation of sexual misbehavior. In separate cases filed in September 2020, two men accused the former judge of sexual abuse.
North Carolina resident Charles Corbishley said he appeared in Napolitano’s court in the 1980s, facing arson accusations. Corbishley said that Napolitano pushed him to have oral sex in return for a reduced sentence.
Fox News stated after Corbishley filed suit saying, “Judge Napolitano has assured us in the strongest possible terms that these charges are baseless and he will defend them hard in court.”
Wantage resident James Kruzelnick also filed a lawsuit against Napolitano, stating that the judge sexually attacked him many times between 2014 and 2017, working as a server in Sparta.
They filed both actions in New York, where Napolitano resides.
He had previously disputed both charges through his attorney, countersued Corbishley.
